Early in his career, Ben began representing three Certified Registered Nurse Anesthetists who were facing exclusion from practicing at a local hospital. The case involved a novel application of the Texas Antitrust Act. Ben successfully obtained a temporary injunction preventing the hospital from excluding the CRNAs from their practice. The case attracted attention across Texas and led to Ben representing CRNAs throughout the state in disputes involving hospitals and anesthesiology groups. For approximately five years, this became a significant part of his practice.
Ben also worked on regulatory efforts in Austin and Washington, D.C., involving independent practice rights for CRNAs. Those efforts ultimately contributed to expanded practice rights and a significant reduction in the type of antitrust litigation he had been handling. From there, his practice increasingly focused on medical malpractice litigation. Ben primarily represented patients and families harmed by medical negligence, while also representing physicians on the defense side of medical malpractice cases.
The antitrust and medical malpractice cases placed him across the table from highly experienced attorneys handling technically complex, high-value litigation. During this period, Ben obtained numerous million-dollar settlements, including one settlement exceeding $5 million.
Ben increasingly focused on family law, civil litigation, and personal injury matters. His years handling complex litigation translated naturally into difficult family law cases, particularly those involving contested custody issues, substantial assets, complicated financial questions, and high levels of conflict.
Today, family law is a central part of the firm's practice. Ben has developed particular experience representing clients in high-conflict custody disputes and complex divorces. He approaches these cases with the same preparation and trial instincts developed through years of sophisticated civil litigation. For clients, that means having an attorney who understands that not every case should go to trial, but who prepares each case with the possibility of trial firmly in mind.
Benjamin has practiced family law since the early 1990s, and family matters have made up a significant portion of his practice for more than two decades.
He has represented clients in contested custody cases, divorces, complex property disputes, support matters, modifications, enforcement proceedings, and numerous other family law matters. His broader litigation background also allows him to represent clients in professional licensure, employment, personal injury, and civil disputes.
Additionally, Benjamin has extensive experience representing licensed professionals facing complaints, investigations, and disciplinary proceedings before Texas licensing boards. This has included representing nurses before the Texas Board of Nursing, psychologists before the Texas State Board of Examiners of Psychologists, dentists before the Texas State Board of Dental Examiners, and physicians before the Texas Medical Board.
Benjamin is admitted to practice in Texas state courts as well as the United States District Court for the Eastern District of Texas, the United States Court of Appeals for the Fifth Circuit, and the United States Supreme Court.
Susan Baker, Benjamin's wife of more than 30 years, serves as his paralegal and works alongside him in preparing cases for hearings and trials. As a mother of three, she brings another perspective to family law matters, particularly those involving children and custody disputes. She attends trials and hearings with Benjamin, and the two work closely together in preparing evidence, developing strategy, and helping clients navigate difficult circumstances.
Their partnership has become a distinctive part of the firm's family law practice.
One opposing attorney once remarked that he would not go to trial against Benjamin without bringing his own wife — also an attorney — because Benjamin and his wife were such a “formidable team.”
